WHEN IS THIS PRIVACY NOTICE APPLICABLE?
This Notice is applicable to the processing of all personal data of Users.
WHO IS THE CONTROLLER OF YOUR DATA?
The Foundation is the controller for the processing of your personal data. The Foundation may pass your information to, or allow access to such information to its subsidiaries, which are all located at the above-mentioned address. The subsidiaries process your personal data as processors in the same way as the Foundation does.
FOR WHAT PURPOSE DO WE PROCESS YOUR PERSONAL DATA?
1. To administer your role as a job applicant or volunteer
- What does this purpose entail?
The Foundation performs extensive research and development in the fields of engineering, oceanography, recycling, maritime law, and more. You may apply for a specific job opening or send us an application, in which case we will process and store your data to administer the application process.
- Which personal data do we process for this purpose?
To process your registration as a job applicant or volunteer and to contact you about your role, the Foundation processes data such as your name, address, e-mail address, telephone number, educational background, abilities, availability, skills, business channels (i.e., LinkedIn, website, portfolio) and other cv information, as well as correspondence relating to
your registration. If you wish to update your data or withdraw from the application process, you can do so by contacting us at: jobdetails@theoceancleanup.com.
- For what period do we retain your personal data for this purpose?
Should your application be refused, we will retain information relating to your job application no longer than is necessary for processing purposes and, in any case, no longer than one month after your application process has been completed, unless you have given permission that we can retain your personal data for a longer period of time, in which case we will retain your data for an additional period of 1 year.
If you become a volunteer, your data will be retained no longer than is necessary for processing purposes and, in any case, no longer than two years after your volunteer role ends. We give you the option to stay in our system for another potential position for 1 year. Upon consent, a new retention period of 1 year applies.
- Third -party volunteer
Our local partners sometimes conduct projects that help with our mission (e.g., beach cleanups). You can sign up to volunteer for these projects. When you sign up to volunteer, we collect personal information such as your name, email address, and general location. We only share your information with trusted partners who support our mission and operate in your area. These partners may contact you directly for volunteering opportunities.
Depending on the nature of the collaboration, we and our partners may act as independent or joint data controllers. Each organization is responsible for handling your information in compliance with applicable data protection laws. 2. For sending you information about job openings
- What does this purpose entail?
If you have sent us an application for a job we would like to retain your application so that we are able to update you on our latest vacancies. We do this by means of e-newsletters if you have indicated to receive these. Our processing of your data is based on your consent to receiving updates from the Foundation.
- Which personal data do we process for this purpose?
For this purpose, we process your name, address, e-mail address, educational background, abilities, availability, skills, business channels (i.e., LinkedIn, website, portfolio), and other CV information, as well as correspondence relating to your application and a record of which e-newsletters we have sent you.
- For what period do we retain your personal data for this purpose?
We retain your personal data for as long as you wish to receive information from the Foundation. In case you no longer wish to receive such information, you can opt out at any time by using the unsubscribe option included in all our emails. If you want us to delete your data, you can contact us via our contact form.
3. For following up on your inquiries
- What does this purpose entail?
You can submit general inquiries to The Foundation via the contact pages on our Websites. These may include, but are not limited to, requests for donation receipts, questions about our mission, activities, and impact, proposals for partnerships or collaborations, feedback on our projects. We process the personal data you provide based on our legitimate interest in efficiently managing inquiries and communications .
You can also submit media inquiries about the Foundation to the private limited company CFF Communications, a corporate and financial communications firm located in Amsterdam, via press@theoceancleanup.com. - Which personal data do we process for this purpose?
For this purpose, we and/or CFF Communications process your name, your contact information, your correspondence with the Foundation about your inquiry, and all other personal data you provide us with and which is required to follow up on your inquiry.
- For what period do we retain your personal data for this purpose?
We retain your data for a period of six (6) months to ensure we can fully address and follow up on your inquiry. This includes a log file containing your name, contact information, the date you contacted us, and the subject of your question.
4. Processing your data for donations and fundraising campaigns
You can help clean the ocean with your online donations. There are two types of donations you can make; a general donation through the Websites (to help us continue our research, improve our technology, and accelerate the largest cleanup in the history) and a donation to your own or someone else’s fundraiser on fund.theoceancleanup.com.
You can make donations to two registered foundations; Euros are donated to Stichting the Ocean Cleanup (an ANBI foundation registered in the Netherlands), and US Dollars, stocks
and cryptocurrency are donated to the American Friends of The Ocean Cleanup, Foundation (a 501C(3) not-for-profit foundation registered in the USA, (AFTOC)). You can get detailed information on how we will process your personal data to process your donation below:
4.1 For processing your general donation(s)
- What does this purpose entail?
Via the Websites, you can submit a general donation form for your general donation(s). The donations made in Euros via the Websites are donated to the Foundation, and such donations are subject to the Donations Terms and Conditions. The donations made in US Dollars via the Websites are donated to the AFTOC, and such donations are subject to the Donations Terms and Conditions. Donations to AFTOC made in stocks or cryptocurrency are processed through Infinite Giving. In such cases, the processing of these donations will be governed by Infinite Giving’s Privacy Policy. We process the personal data you provide based on our legitimate interest in managing your donation, responding to any related inquiries, expressing our appreciation for your support, and ensuring compliance with our legal obligations as a foundation. We may contact you if you start but do not complete a donation to check whether you experienced any issues and to offer assistance. We rely on our legitimate interests in providing support and improving our services for this processing.
- Which personal data do we process for this purpose?
For this purpose, we process your name, address (sharing your address with us is optional unless you request a donation certificate), e-mail address, payment details, correspondence with the Foundation or AFTOC about your inquiries concerning your donation(s), and all other personal data you provide us with and which is required to follow up on your inquiries.
- For what period do we retain your personal data for this purpose?
In compliance with our legal and financial obligations, including tax record-keeping, anti-money laundering regulations, and other relevant financial requirements, we retain the necessary data related to your donation(s) for a period of seven (7) years after you cease donating. This retention period ensures that we meet all legal, auditing, and regulatory obligations associated with your donation.
4.2 For processing your donation(s) made through fundraising campaigns
- What does this purpose entail?
Via fund.theoceancleanup.com you can submit a donation to your own or someone else’s fundraiser. The donations made in Euros are donated to the Foundation, and such donations are subject to these Terms and Conditions. The donations made in US Dollars, stocks and cryptocurrency are donated to the AFTOC, and such donation(s) are subject to these Terms and Conditions. As the set-up and management of fundraising campaigns is supported by Funraisin (for further details on their privacy policy please refer to: https://www.funraisin.co/privacy-policy ), we receive your personal data from Funraisin and act as the controller for the processing of such personal data. We will use the personal data provided to process your donation(s), follow up on your inquiries concerning your donation(s), thank you for your support, send you updates related to your donation, and fulfill our legal and financial obligations as a foundation regarding your donation(s). We may contact you if you start but do not complete a donation to a fundraising campaign to check whether you experienced any issues and to offer assistance. We rely on our legitimate interests in providing support and improving our services for this processing.
- Which personal data do we process for this purpose?
For this purpose, we process your name, username or company name, e-mail address, payment details, correspondence with the Foundation or AFTOC about your inquiries concerning your donation(s), and all other personal data you provide us with and which is required to follow up on your inquiries.
- For what period do we retain your personal data for this purpose?
In compliance with our legal and financial obligations, including tax record-keeping, anti-money laundering regulations, and other relevant financial requirements, we retain the necessary data related to your donation(s) for a period of seven (7) years after you cease donating. This retention period ensures that we meet all legal, auditing, and regulatory obligations associated with your donation. Personal data processed to follow up on inquiries related to your donation(s) will be retained for a period of six (6) months to ensure we can fully address and follow up on your inquiry.
4.3 For registering a fundraising campaign for The Ocean Cleanup
- What does this purpose entail?
Via fund.theoceancleanup.com you can create a fundraising campaign to collect donations for the mission of The Ocean Cleanup. Funraisin, which supports the setup and management of fundraising campaigns, provides us with your personal data, which we will use to register your fundraising campaign, send you updates related to your campaign, and showcase your campaign in our newsletters, website, and social media to inspire other fundraisers. As the setup and management of fundraising campaigns are supported by
Funraisin (for further details on their privacy policy, please refer to: https://www.funraisin.co/privacy-policy), we receive your personal data from Funraisin and act as the data controller for the processing of such data, with Funraisin acting as the data processor on our behalf.
- Which personal data do we process for this purpose?
Processing of your data is necessary for the performance of our contract with you with regards to your fundraising campaign. For this purpose, we process your name, username, or company name and email address to send you updates on your campaign or to follow up on any inquiries related to registering your campaign. Your campaign can be added to the fundraiser page/homepage to inspire others. If you have added a personal profile picture, this will appear in your fundraiser. Processing of your personal data after your fundraising campaign has been archived or deleted will be based on and subject to your consent.
- For what period do we retain your personal data for this purpose?
We retain your personal data until your fundraising campaign is archived or deleted. In case you have indicated you wish to stay updated on the projects of The Ocean Cleanup through periodic newsletters, you will continue to receive these unless you unsubscribe by using the unsubscribe option included in all our emails.
5. If you participate in The Ocean Cleanup events, to administer your participation
- What does this purpose entail?
If you participate in The Ocean Cleanup events, we will process your data to be able to organize the event, count participants, and to measure the response to the events. We can send you e-mails to keep you updated on the event, and send you tickets and logistical information. The processing of your data is based on our legitimate interests in successfully organizing and administering the event and in maintaining relationships with event participants.
- Which personal data do we process for this purpose?
For this purpose, we use your name, address, e-mail address and any other relevant information you share with us in relation to the event.
- For what period do we retain your personal data?
We store your personal data for a period of six (6) months after the event.
6. Sending you information about the Foundation by e-mail
- What does this purpose entail?
We would like to keep you updated on our latest vacancies, events, developments, news items, and other opportunities and developments within the Foundation. We will do this by means of e-newsletters. If you would like to stay informed on these topics, you can indicate this by subscribing through our Websites, while donating, applying for a job, in the footer, and/or any other form which allows for newsletter subscription.

For this purpose, we process your name, your e-mail address and a record of which e-newsletters we have sent you to be able to make the emails we send you more relevant.
- For what period do we retain your personal data?
We retain your personal data on the basis of your explicit consent for as long as you wish to receive information from the Foundation. 7. For the development and improvement of our Websites

We perform research into our Users’ visit and click behavior through statistical analysis. We use the anonymized results of such research to better understand how people interact with our services, to monitor aggregate usage and web traffic routing on our services, and to customize and improve our websites. If you have purchased merchandise from theoceancleanupstore.com, please note that both The Ocean Cleanup and Teemill, the platform that powers and hosts our merch store, act as separate data controllers. The Ocean Cleanup stores your data and purchase history to send you updates about similar products you might be interested in. If you prefer not to receive these communications, you can unsubscribe at any time using the unsubscribe option provided in each email. In addition, Teemill processes your personal data independently for their own purposes, such as fulfilling orders, optimizing product development, and improving customer experience. We may contact you if you start but do not complete a merchandise purchase to check whether you experienced any issues and to offer assistance. 10. For research and technology monitoring purposes
- What does this purpose entail?
The Ocean Cleanup (TOC) carries out research in order to develop optimal ocean and river cleanup technologies. For research purposes and performance monitoring of our technologies, we use cameras to determine and monitor the behavior of rivers and waste in rivers. This situation is unique as cameras may capture data of a cross-border nature, as well as sensitive data unique to an environment where confidential information could be recorded.
In rare scenarios, these cameras may capture personal data. The organization has taken measures to avoid such situations including privacy filters, masking functions, adapting the areas and angles of the cameras, and implementing contractual agreements.

WHO HAS ACCESS TO YOUR DATA?
The Foundation uses third parties for the processing of certain data, such as Website hosting, communications and payment processing. As far as these third parties have access to personal data to execute this kind of data processing, the Foundation has taken the required organizational and contractual measures to ensure that your personal data is exclusively processed for the purposes mentioned above. Only if the Foundation is required to do so by law, will your personal data be provided to supervisory agencies, fiscal authorities, and investigative agencies.
Online general donations made via the Website to the Foundation will, through the private limited company FinDock B.V. (whose privacy statement can be found at: https://findock.com/privacy/ will be collected and processed by the one of the following online payment providers: private limited company Buckaroo B.V. (Buckaroo), Stripe Payments Europe, Limited (Stripe) or PayPal (Europe) S.à r.l. et Cie, S.C.A (PayPal). which will gather payment details and your e-mail address, to communicate with you about payment-related matters. WHICH COOKIES DOES THE FOUNDATION USE?
The Websites use the cookies listed in the table at the bottom of this notice. A cookie is a small text file that we send to your internet browser. Cookies can collect data on the use of the Website such as which pages are visited and the duration of a user session. When you use the Website, the cookie sends data to the Foundation or to a third-party service provider, such as Google Analytics or Microsoft Clarity.
The Foundation does not retain a cookie longer than necessary. We use session cookies and permanent cookies. A session cookie can track usage such as the web pages you visit and what options you use. When you close the internet browser, the session is ended and the cookie is deleted. A permanent cookie enables the Websites to recognize you at a subsequent visit.
The Foundation places and stores functional cookies, to enable functionalities of the Websites. The Foundation also places analytical cookies with no or minimal impact on a data subject’s privacy, which help us analyze the use of the website, to see if we can improve certain features, solve potential bugs, make the overall experience better, see how our website is being visited over time and what content is liked most and least. HOW TO TREAT LINKS TO OTHER WEBSITES AND SOCIAL MEDIA?

When using such merchandising websites, please note that both The Ocean Cleanup and Temill operate as separate data controllers. However, any data collected by The Ocean Cleanup through the merchandise store is processed in accordance with The Ocean Cleanup’s privacy policy, and The Ocean Cleanup remains responsible for that processing.
MAY PERSONS BELOW THE AGE OF 16 PROVIDE PERSONAL DATA?
Persons below the age of 16 may only provide personal data to the Foundation if they have the permission of one of their parents or their legal guardian who has read this Notice.
HOW DO WE SECURE DATA?
